Phoenix City Court / Phoenix Municipal Court – – Misdemeanor DUI / Regular DUI / Extreme DUI / Super Extreme DUI / 2nd Time Regular DUI / 2nd Time Extreme DUI / 2nd Time Super Extreme DUI – Arizona Revised Statute 28-1381 & 28-1382

The Phoenix Municipal Court (AKA Phoenix City Court) is where nearly all Misdemeanor DUI cases where the arrest occurred within the Phoenix city limits will go. The only exceptions include when an arrest was done by a Department of Public Safety or Maricopa County Sheriff’s Office Deputy. In those situations, it is possible that your DUI in the city limits of Phoenix would be heard before a Justice Court rather than Phoenix City Court. The other possible exception could be that if DUI was charged along with a Felony Criminal or Vehicular Offense, then the DUI might be heard in Maricopa County Superior Court.

Phoenix Municipal Court is one of the largest City Court Complexes in the State of Arizona. It has approximately 20 judges that oversee all charges of Misdemeanor DUI, including:

Underage Driving with Alcohol in the body (AKA Baby DUI / AKA Underage DUI / AKA Under 21 DUI) – Arizona Revised Statute §4-244(34)

One of the biggest downsides to Phoenix Municipal Court is in the way that the Phoenix City Prosecutors interpret Arizona Law. It simply is not possible to get something less than a DUI either by way of a plea agreement or at trial. Something like Reckless Driving, which can be a possible plea agreement in other city courts, is not possible in Phoenix City Court.

This is an incredibly important reason why anyone charged with a DUI in Phoenix Municipal Court wants to have an experienced DUI Defense Lawyer, who is familiar with the ins and outs of how Phoenix City Court operates.

Because there is no ability to “plea down” to a Reckless Driving, or any other type of offense, other than a DUI, you want to make sure that you have someone on your side that focuses on DUI Defense, and knows the hidden benefits of Phoenix Municipal Court, and some of the hidden programs that could take something like months in jail, and reduce it down to a few weeks in jail.

Or, if trial truly is your best option, you want to make sure that you have your best shot of winning through pre-trial motions, or arguing for Innocence or Not Guilty in front of a jury.

You want to have a DUI Attorney who is focused on DUI Defense, not someone who only dabbles in DUI Defense when they are not representing people on their divorces, bankruptcies, or criminal charges. A DUI Lawyer is not the same as a Criminal Lawyer.

If you are charged in Phoenix City Court, you want an Attorney who is experienced and focused on DUI Defense Representation. Your best change of success is with an AZ DUI Team Lawyer on your side.
