The Tempe City Court is a bit different than most other City, Municipal, or Justice Courts in Maricopa County, Arizona. This distinction between Tempe and most other courts is why it is important to have an experienced DUI Defense Lawyer representing you on your DUI case in Tempe.

There are certain provisions in the law that nearly all other courts in Maricopa County County will follow…. but not Tempe. For example, there is an ability for a person charged with Extreme DUI or Super Extreme DUI to have time deducted from a sentence for installing and maintaining an Ignition Interlock Device in any vehicle that is operated for one year. Tempe City Court Judges will not permit the utilization of this benefit.

The theory from the Tempe Municipal Court Judges is that the court has no way to ensure that a person convicted of a DUI has truly installed and maintained an Ignition Interlock Device on their vehicle in order to warrant the reduction in sentence, therefore they simply will not allow DUI Defendants to utilize the benefit.

Without that benefit being available on Tempe DUI cases, it is important to have a Tempe DUI Lawyer who is not only aware of this situation in the Tempe City Courts, but knows how to ensure that if their client is convicted of a DUI, or will be pleading Guilty to a DUI, what can otherwise be done to prevent a DUI Defendant from doing an unreasonable jail term.
